Agreement (hereinafter referred to as the “Agreement”) sets forth legally binding terms for your use of the Website. By using our Website, you agree to be bound by this Agreement, regardless of wether you are a “Visitor” (if you a simply browsing the site) or you are a “Member” (you have registered for a subscription). If you chose to not accept the terms of this Agreement, please leave our Website and discontinue use immediately. We may modify this Agreement when necessary, any modifications will be effective immediately which you agree to be bound by any modifications after they are posted. DISCLAIMER & ASSUMPTION OF RISK
Treeline Online aerial video content is intended as a supplementary tool of reference for those taking classes with a certified instructor. All rigging should be done by a certified rigger with certified rated equipment.Treeline Aerial Performance Arts Ltd is not responsible for the safety of your aerial rigging equipment nor the installation of this equipment, this should be done by a professional rigger. You should always practice aerial with a thick crash mat underneath you.
In consideration of Treeline Aerial Performance Arts Ltd providing to me services, including, without limitation, instruction, classes (both in studio and online) and training in (1) aerial silks; (2)aerial hoop; (3)static trapeze (4) aerial hammock (5) aerial yoga (6) pole (7) aerial straps (8)aerial conditioning (9) flexibility (10) handstands and other circus arts training (herein after collectively referred to the ACTIVITIES), I agree to RELEASE, SAVE HARMLESS AND INDEMNIFY Treeline Aerial and its affiliates, employees, volunteers, contractors and owners (collectively, the RELEASEE) of and from any and all manner of actions, claims, costs, damages, expenses, suits, contracts, and personal injury of any nature or kind whatsoever and howsoever caused, arising out of, or in connection with my use of the premises and equipment notwithstanding that the same may have been contributed to or occasioned by an act or failure to act, including, without limitation, negligence of Treeline Aerial Performance Arts Ltd and or anyone or more of its agents. I understand that negligence includes failure on the part of Treeline Aerial Performance Arts Ltd to take reasonable steps to safeguard or protect me from the risks, dangers and hazards of the activities.
By remaining on our website and/or accessing and/or using our program you acknowledge that you are fully aware of the risks, dangers and hazards of participating in the activities and fully accept and fully assume all such risks and unanticipated risks, including but not limited to soreness, burns, serious injury to body, emotional or mental injury, paralysis or death to yourself or to third parties. Your participation is completely voluntary and you elect to participate in spite of the risk outlined above.

This includes, but is not limited to images, text, logos, documents,videos, video content, downloadable files and anything that contributes to the composition of our Site.

MEMBERSHIPS
You agree that this subscription service is for your personal use only and account information may not be shared, sold or given to any other person or entity. Any suspicion of fraudulent use of membership will result in immediate cancellation without a refund.
FREE TRIAL PERIOD
Our 7-day free trial period may only be used once. After the free trial Members will be automatically enrolled into the subscription package they originally selected when they initially signed up to use the Website. Treeline Aerial Performance Arts Ltd reserves the right to terminate any account that is using or trying to use more than 1 free trial period. Billing Memberships are billed monthly. All memberships are renewed automatically until cancelled. Members may cancel their membership at any time free of charge. Membership must be canceled prior to the renewal date in order to end membership charges. To cancel simply email us at info@treelineaerialbc.com or unsubscribe through your personal profile on our Wellness Living platform.

The services will be paid for in full when the services are ordered.

All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk.
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

REFUNDS

Refunds for Services
We do not issue refunds or credits for unused subscriptions or partial months. When you cancel your Treeline Online account you will no longer be charged the monthly subscription fee.
CONSUMER PROTECTION LAW
Where the Business Practice and Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
LIMITATION OF LIABILITY
Treeline Aerial Performance Arts Ltd and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
INDEMNITY
Except where prohibited by law, by using this Site you indemnify and hold harmless Treeline Aerial Performance Arts Ltd and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
